Disputes Between Neighbors
While everyone hopes to enjoy a great relationship with their neighbors, unfortunately this is not always possible, because not all neighbors demonstrate respect for others’ property rights. I handle a wide variety of disputes between neighbors, including:
- Trespass actions
- Adverse possession claims
- Easement and right-of-way disputes
- Prescriptive easements
- Boundary line disputes
- Title disputes, including claims against title insurance companies to insure and defend
- Actions under Article 15 of the New York Real Property Actions and Proceedings Law, sometimes called “quiet title” or “bar claim” actions
- Disputes regarding the interpretation and/or reformation of deeds
- Disputes regarding restrictive covenants
- Disputes regarding conservation easements
- Disputes regarding unauthorized cutting of trees or shrubs
- Nuisance (i.e., property uses that disturb neighbors and interfere with their use and enjoyment of their property)
- Claims arising from flooding and poor drainage
- Actions for neighbors’ zoning violations
